SKULP’D – Terms of Use & Membership Agreement

These Terms of Use and Membership Agreement (“Agreement”) constitute a legally binding contract between you (“Member”) and SKULP’D Wellness Studio LLC (“Studio”), Triple 7 Center, Al Wasl Road, Level 1, Shop F03, Dubai, UAE (skulpd.ae). BY ACCESSING THE WEBSITE, BOOKING A CLASS, OR ENTERING THE STUDIO PREMISES, YOU AGREE TO BE BOUND BY THIS AGREEMENT.
1. ELIGIBILITY
You must be at least 18 to purchase membership or book classes. Persons aged 14–17 may participate only with written parental consent and adult supervision.
2. CODE OF CONDUCT
All persons must behave respectfully and lawfully. Prohibited: harassment or discrimination; recording without written consent; entry under influence of alcohol or drugs; sharing membership credentials; aggressive behaviour. The Studio may remove any person without refund.
Appropriate athletic attire required. Studio operates Monday–Friday 6:30 AM–8:00 PM and Saturday–Sunday 8:00 AM–5:00 PM. Closed UAE public holidays.
3. BOOKINGS, CANCELLATIONS & NO-SHOW POLICY
Classes must be booked via official platforms (Mindbody app or website). You must cancel at least 12 hours before class start to avoid a late cancellation penalty. No-shows and late cancellations result in forfeiture of the class credit — no refunds or substitutions.
4. FEES, PAYMENTS & REFUNDS
All prices are in AED, inclusive of VAT. All sales are final. Refunds are only issued where required by UAE Consumer Protection law, or where a class is cancelled by the Studio. Class credits expire as described at purchase; expired credits are forfeited.
5. HEALTH, SAFETY & MEDICAL DISCLAIMER
By participating, you confirm you are in good physical health. If you have any pre-existing medical condition, injury, or are pregnant, you must obtain written clearance from a qualified medical practitioner before class. Instructors are fitness professionals, not medical practitioners. You voluntarily assume all risks of participation.
6. LIMITATION OF LIABILITY
To the maximum extent permitted by UAE law, the Studio and its owners, instructors, and staff shall not be liable for personal injury, loss of property, or indirect damages arising from use of the Studio. The Studio’s total liability shall not exceed amounts paid by you in the 30 days preceding the event.
You agree to indemnify and hold harmless the Studio Parties from claims arising out of your use of the Services, breach of this Agreement, or violation of any law.
7. PHOTOGRAPHY & SOCIAL MEDIA
Recording, filming, or photographing classes without express written consent of the Studio and all depicted persons is strictly prohibited. The Studio may photograph group classes for marketing; notify the Studio in writing if you do not wish to be photographed.
8. INTELLECTUAL PROPERTY
All content on the SKULP’D website, app, and marketing materials is the exclusive property of SKULP’D Wellness Studio LLC, protected under UAE Federal Decree-Law No. 38 of 2021.
9. MEMBERSHIP FREEZE & TERMINATION
Memberships may be frozen for 2 weeks to 3 months per year with 7 days’ written notice. The Studio may terminate memberships immediately for breach of this Agreement, harmful conduct, or non-payment. Members cancelling monthly memberships must provide 30 days’ written notice to info@skulpd.ae.
10. GOVERNING LAW & DISPUTES
This Agreement is governed by the laws of the UAE and the Emirate of Dubai. Disputes shall first be addressed by good-faith negotiation; unresolved disputes within 30 days shall be referred to the exclusive jurisdiction of the courts of Dubai. Nothing limits a consumer’s rights under UAE Federal Law No. 15 of 2020.
11. AMENDMENTS
The Studio may amend this Agreement at any time. Continued use of the Services after publication of amendments constitutes acceptance.
